1. Acceptance of Terms

By creating an account, subscribing to a plan, or using the GoMon tools, you represent that you are at least 18 years old and legally competent to enter into this agreement. If you are using the Services on behalf of a business or entity, that business or entity accepts these Terms.

2. Description of Services

GoMon provides advanced software, analytics, and tools designed for generating SEO reports and optimizing websites. GoMon reserves the right to modify, update, or temporarily or permanently discontinue any features or aspects of the tools at any time.

3. Account Types: Free and Paid Accounts

We offer different types of accounts to access our SEO tools and reports:

  • Free Accounts: GoMon may provide access to certain tools free of charge ("Free Account"). Free Accounts have limited features, strictly capped usage tiers, and lower data thresholds. GoMon reserves the right to modify, restrict, or terminate Free Accounts or free features at any time without prior notice.
  • Paid Subscriptions: Users can upgrade to a paid plan ("Paid Subscription") to unlock advanced reporting features, higher usage limits, API access, and white-label options. Features vary based on the selected tier.

4. Accounts and Security

To access our SEO tools and features, you are required to register for an account. You are solely responsible for:

  • Maintaining the confidentiality of your login credentials (username and password).
  • All activities that occur under your account.
  • Promptly notifying GoMon of any unauthorized use of your account or any other breach of security.

5. Acceptable Use (Fair Use Policy)

You agree to use our tools and reports strictly for legitimate SEO and marketing purposes. You are strictly prohibited from:

  • Overloading GoMon’s infrastructure or servers (e.g., through automated scripts, scrapers, or excessive API abuse). Free Accounts may face stricter rate-limiting.
  • Decompiling, reverse-engineering, or distributing the underlying code, data structures, or proprietary mechanics of the tools without prior written consent.
  • Utilizing our systems for any illegal activities or to distribute malware.

6. Fees, Billing, and Downgrades

The following terms apply specifically to our Paid Subscriptions:

  • Billing: Subscriptions are billed in advance on a recurring monthly or annual basis, depending on your chosen plan.
  • Automatic Renewal: Unless specified otherwise, subscriptions automatically renew until canceled through your account dashboard.
  • Downgrades and Data Loss: If you cancel your Paid Subscription or downgrade to a Free Account, your access to advanced features will terminate at the end of the current billing cycle. GoMon is not liable for any data loss, expired reports, or custom configurations that occur as a result of a downgrade.
  • Refunds: Refunds are generally not provided for partially used periods or historical terms, unless required by applicable consumer law.

7. Intellectual Property

All intellectual property rights regarding the GoMon software, visual design, brands, logos, and generated tool frameworks remain the exclusive property of GoMon. Reports explicitly generated for your website or your client's website may be used, shared, and white-labeled by you, subject to the features allowed in your specific subscription plan (white-labeling is generally excluded from Free Accounts).

8. Disclaimer of Warranties

GoMon provides its services on an "as is" and "as available" basis. Search Engine Optimization depends heavily on third-party factors (such as search engine algorithms). GoMon provides **no warranty or guarantee** that:

  • The generated data, insights, or recommendations will lead to specific rankings, traffic increases, or conversions on search engines.
  • The tools will operate uninterrupted, completely error-free, or with 100% real-time accuracy.

9. Limitation of Liability

To the maximum extent permitted by law, GoMon shall not be liable for any indirect, incidental, special, or consequential damages (including loss of profits, revenue, data, or business reputation) arising out of or in connection with the use or inability to use our SEO tools and reports.

10. Amendments to Terms

GoMon may revise these Terms from time to time. For material updates, we will notify active users via email or through a clear notification in the dashboard. Your continued use of the tools after such updates constitutes acceptance of the new Terms.

11. Governing Law and Jurisdiction

These Terms and your use of GoMon's Services shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these Terms will be submitted exclusively to the competent court in the jurisdiction where GoMon is established.
